PLEASE READ THESE TERMS OF USE CAREFULLY BEFORE USING THE KENTUCKY OUT-OF-SCHOOL ALLIANCE MESSAGE BOARDS

Agreement to the following Terms of Use is required in order to participate (post) in the Kentucky Out-of-School Alliance Message Boards.
By using any Kentucky Out-of-School Alliance Message Boards or by clicking a box that states that you accept or agree to these terms, you signify your agreement to these terms of use and agree that you, the user, are 18 years of age or over and are fully responsible for any information or files you post. You also agree that you will not post any copyrighted material that is not owned by yourself. If you do not agree to these terms of use, you may not use the Kentucky Out-of-School Alliance Message Boards.

In order to post in the Kentucky Out-of-School Alliance Message Boards, users are required to provide a: (1) User Name, (2) Password, (3) Valid E-mail Address. After registering for the Kentucky Out-of-School Alliance Message Boards, please write down and store your user name and password in a safe place. The Kentucky Out-of-School Alliance will be unable to assist you with account problems if you are unable to provide your unique user name and password. Also, we respect your privacy and will not share your user name and/or password with other organizations.

The Kentucky Out-of-School Alliance Message Boards are provided as a community service and features offered therein are for public and not private communications, therefore you should have no expectation of privacy with regard to any submission to the Kentucky Out-of-School Alliance Message Boards. The Kentucky Out-of-School Alliance cannot guarantee the security of any information you disclose through the message boards; and you make such disclosures at your own risk. Remember that all information disclosed in the Message Boards becomes public and you should exercise caution when deciding to share anything personal.

By agreeing to these terms of use, you authorize the Kentucky Out-of-School Alliance to remove or modify any data submitted by you to these Message Boards for any reason we feel constitutes a violation of our policies, whether stated, implied or not. All users are expected to be courteous, use respect and good manners, and to adhere to the following etiquette guidelines:
1. Obscene, bigoted, vulgar, or sexually explicit language is not allowed. We reserve the right to remove postings that contain obscene, bigoted, insulting, abusive, or hateful content, and suspend or terminate the guest accounts of anyone who posts such content. Any harassing notes or postings that might be construed as stalking or flaming will be deleted, and we reserve the right to inform and/or provide assistance to law enforcement agencies in any way we deem appropriate. We also reserve the right to remove notes that are off the subject or not in English.
2. The Swop & Shop provides the only place you should list items to buy, sell, trade or barter – professionally used equipment, materials, software, etc., one-to-one transactions only. Solicitations or advertisements are not allowed in the Swop & Shop or anywhere else on the Kentucky Out-of-School Alliance Messsage Boards. We reserve the right to remove all such solicitations and advertisements.
3. Disagreements may occur, but flaming is not allowed. If flaming should occur, we reserve the right to remove the content and to suspend any account we deem necessary.
4. You may not suggest, encourage, boast about, or discuss your participation in, any illegal activity. If illegal activity is discussed on message boards or in chat rooms, we reserve the right to inform and/or provide assistance to law enforcement agencies in any way we deem appropriate.
5. You must have copyright ownership of all material that you post on our message boards and in our chats. No articles, recipes, song lyrics, art, graphics, or other material may be posted without the express written consent of the copyright holder.
6. You should never give out any personal information about yourself or anyone else, and never ask for personal information from others.
7. Multiple postings of the same note are not allowed.
8. You participate at your own risk on the message boards, in chat, and in e-mail. All chats may be monitored by our staff members or volunteers of the Kentucky Out-of-School Alliance. You take responsibility for postings under your identification and use the information provided on this site, including on message boards, chat, and e-mail, at your own risk. We take no responsibility for the content or opinions posted on message boards, chat, and e-mail.
9. The Kentucky Out-of-School Alliance reserves the right to delete content or features at any time, in any way, for any or no reason.
10. If you see any chat, or message board post that you feel violates any of the above house rules, please notify the Kentucky Out-of-School Alliance by e-mail chudman@kyoutofschoolalliance.org.
11. The Kentucky Out-of-School Alliance reserves the right to amend these guidelines at any time it deems necessary.
12. The Kentucky Out-of-School Alliance cannot and does not take responsibility for any advice given, information provided, reference to other resources, nor do we take any responsibility for items listed to buy, sell, trade or barter in the Special Use Forums.
13. Any user who finds material posted by another user objectionable should contact the Kentucky Out-of-School Alliance Message Board Administrator chudman@kyoutofschoolalliance.org.

INDEMNIFICATION: By using the Kentucky Out-of-School Alliance message boards, you agree to all terms of use and are responsible for maintaining the confidentiality of your username and password, as well as all activities that occur under your account. You hereby agree to indemnify, defend, and hold us, our licensors, licensees, distributors, agents, representatives and other authorized users, and each of the foregoing entities' respective resellers, distributors, service providers and suppliers, and all of the foregoing entities' respective officers, directors, owners, employees, agents, representatives and assigns (collectively, the "Indemnified Parties") harmless from and against any and all losses, damages, liabilities and costs (including settlement costs and any legal or other fees and expenses for investigating or defending any actions or threatened actions) incurred by the Indemnified Parties in connection with any claim arising out of any breach by you of these terms of use or claims arising from your use of the Kentucky Out-of-School Alliance Message Boards account. You shall use your best efforts to cooperate with us in the defense of any claim. We reserve the right, at our own expense, to employ separate counsel and assume the exclusive defense and control of any matter otherwise subject to indemnification by you.

The Kentucky Out-of-School Alliance Message Boards may contain the opinions and views of other users. Given the interactive nature of these sites, we cannot endorse, guarantee, or be responsible for the accuracy, efficacy, or veracity of any content generated by our users.
